Instructions: a) In November 1983, Hustler Magazine ran a parody of an advertisement poking fun at the evangelical Christian leader, Jerry Falwell. Falwell sued claiming libel and the case eventually made its way to the Supreme Court as a First Amendment issue. Visit The Oyez Project’s website and look up Hustler Magazine v. Falwell and listen to the announcement of the Court’s decision in the case. Do you agree with the Court’s decision based on the First Amendment’s protection of freedom of speech? In your opinion, what (if any) are the constitutional limits of comedic speech?
b) The right to privacy has been recognized by the Supreme Court in a variety of cases yet these words do not appear in the actual text of the Constitution. Read through the first ten amendments to the Constitution (the Bill of Rights) and explain whether you agree with the Supreme Court that a right to privacy is implied there. Base your argument on specific provisions of the first ten amendments to the Constitution.
